Current Bill Summary

SB 391 - This act provides that the Attorney General shall have concurrent jurisdiction with any circuit or prosecuting attorney of this state in cases involving any class A felony or felony sexual offense.

Upon receiving a referral from a law enforcement agency, the Attorney General may commence prosecution within 60 days of such referral and may prosecute any additional violations connected to the underlying offense.

If the circuit or prosecuting attorney commences a prosecution prior to the Attorney General, the Attorney General shall also have the authority to adopt or amend the complaint, information, or indictment and the circuit or prosecuting attorney must immediately withdraw from the prosecution.

This act is substantially similar to SB 83 (2023), SB 197 (2021), and SB 889 (2020).
