SB 1131 - This act modifies provisions relating to arrests by private persons.

DETENTIONS BY A MERCHANT (Section 537.125)

Under current law, any merchant or his or her employee, who has reasonable grounds or probable cause to believe that a person is wrongfully taking merchandise or money from the establishment may detain such person in a reasonable manner. This act repeals the "probable cause" requirement.

ARRESTS (Section 544.180)

This provision shall be known and may be cited as "The Ahmaud Arbery Act". This act provides that a private person's right to make an arrest as it existed under the common law of Missouri is abrogated, except as provided in law relating to merchants detaining individuals or individuals acting in self-defense.

PRIVATE PERSON'S USE OF FORCE DURING ARREST (Section 563.051)

This act repeals provisions relating to a private person's use of force in effecting an arrest when not directed by a peace officer. Any individual detained by a private person who was directed by a peace officer shall be surrendered to the peace officer within a reasonable time and with any personal belongings that may have been removed from the individual.
