SB 433 - This act modifies and creates new provisions relating to legal notices.

PUBLICATION OF STATEWIDE BALLOT MEASURES

(Section 116.260)

The act modifies the requirements for the publication of statewide ballot measures by the Secretary of State to be in conformity with the Missouri Constitution. Specifically, such measures shall be published once a week for two consecutive weeks in two newspapers of different political faith in each county, the last publication to be not more than thirty nor less than fifteen days next preceding the election. If there is only one newspaper in any county, publication must be made for four consecutive weeks.

NOTICE OF UNCLAIMED PROPERTY

(Section 447.541)

The act additionally modifies the notice requirements required to be made by the State Treasurer for purposes of disposing of unclaimed property. Specifically, current law requires the Treasurer to give notice of property that is presumed to be abandoned as follows:

· Notice must be published in a newspaper of general circulation once a week for two successive weeks within 240 days of receiving notice of property that is presumed to be abandoned; and

· Notice must be mailed to each person having an address listed who appears to be entitled to presumed abandoned property valued at $50 or more.

This act allows the State Treasurer to use any other method, in addition to the above methods, he or she deems appropriate and consistent with the intent to notify the owners of the property.

This provision is identical to SB 408 (2021), a provision in HCS/SS/SCS/SB 27 (2021), a provision in HCS#2/SCS/SB 91 (2021), a provision in HCS/SS/SCS/SBs 53 & 60 (2021), a provision in the perfected HCS/HB 512 (2021), and HB 730 (2013) and substantially similar to a provision in HB 1345 (2021) and a provision in HB 926 (2021).

LEGAL NOTICES WEBSITE

(Section 493.077)

Under current law, many legal notices are required to be published by a public body or an organization regulated by the state in a newspaper of general circulation within a particular area. This act provides that publication of any such notice shall be considered to have been met if it is posted on the Legal Notices Website required to be established and maintained by the Office of Administration, pursuant to this act.

This provision is substantially similar to a provision in SB 268 (2019).
