Current Bill Summary

SB 345 - Under current law, a person commits the offense of resisting or interfering with arrest if he or she knows or reasonably should know that a law enforcement officer is making an arrest and attempts to prevent the arrest by using or threatening violence or by fleeing. This offense is a Class A misdemeanor, unless the person fleeing creates a substantial risk of serious physical injury or death to any person then the offense is a Class E felony.

This act adds that it shall be a Class E felony if the person flees arrest by operating a motor vehicle resulting in pursuit by a law enforcement officer operating a motor vehicle.

This act is similar to SB 432 (2021).
