SB 564 - Under current law, if a person is found guilty of a second or subsequent offense of driving while intoxicated, the court may order the person to submit to a period of continuous alcohol monitoring or testing.

This act adds that if a person is found guilty of a second or subsequent offense of driving while intoxicated within a two year time period, the court shall order such person to undergo a risk and needs assessment to determine if the person will benefit from a community-based substance use disorder treatment program. Upon considering the result of the risk and needs assessment, the court may refer the person to a community-based substance use disorder treatment program that offers one or more forms of medications that are approved for the treatment of alcohol or drug dependence by the U.S. Food and Drug Administration.
