SB 443 - This act establishes the "Right to Due Process Act". Under this act, the General Assembly finds that the life of each human being begins at fertilization and each person is deemed a person beginning at the time of fertilization. Children in women's wombs and their parents have protectable interests in the life, health, and well-being of such children. Under current law, an unborn child has all the rights, privileges, and immunities available to other persons, citizens, and residents of Missouri, subject to the U.S Constitution and the decisional interpretations of the U.S. Supreme Court, as well as contrary provisions in state law and state court decisions. This act repeals such restrictions on the rights of a child in a woman's womb. Law enforcement officers, officers of the court, and any licensed or state-regulated entities shall affirmatively enforce the provision of the Missouri Constitution that states no person shall be deprived of life, liberty, or property without due process of law. This act changes "unborn children" to "children in women's wombs" in certain statutes. This act is identical to HB 1799 (2020). SARAH HASKINS
