SB 993 - This act establishes the "Free Speech in Medicine Act." Under this act, no official, employee, or agent of this state shall enforce or otherwise prosecute a pharmaceutical manufacturer, or its representatives, for engaging in truthful promotion of off-label use of a drug, biological product, or medical device. No state regulatory board shall revoke, fail to renew, or take any other action against the license or registry of any pharmaceutical manufacturer, or its representatives, or any health care provider solely for engaging in truthful promotion of off-label use of a drug, biological product, or medical device. The state, and any political subdivision of the state, shall be prohibited from using any personnel or financial resources to enforce or cooperate with federal attempts to enforce or apply certain federal laws against, or otherwise prosecute, a pharmaceutical manufacturer, or its representatives, for engaging in truthful promotion of off-label use of a drug, biological product, or medical device. Finally, nothing in this act shall require a health carrier, other third-party payer, or other health plan sponsor to provide coverage for off-label treatment, nor shall anything in this act prohibit such entities from providing such coverage.
