House Amendment

HCS/SB 202 - Starting in fiscal year 2020, moneys disbursed to the Missouri Office of Administration from the Office of Natural Resources Revenue within the U.S. Department of the Interior from mining royalties on federal land located within the state shall be distributed on a proportional basis by the Office of Administration to each county in this state where such mining royalties accrued.

Each county that receives money shall allocate 50% for public schools, to be distributed to districts based on their reported average daily attendance, 25% for the maintenance of roads and bridges in the county, and 25% for the following areas in a county's public safety budget: the Sheriff's department, jail and care of prisoners, the Office of Prosecuting Attorney, juvenile officer, and Coroner. The money to be used for a county's public safety budget shall be allocated at the discretion of the county commission.

This act is identical to HCS/HB 460 (2019).

HA 1: CHANGES THE TITLE TO "PRIVATE ENTITIES USE OF LAND".

HA 2: ADDS PROVISIONS STATING THAT PRIVATE ENTITIES, AS DEFINED IN THE AMENDMENT, SHALL NOT HAVE THE POWER OF EMINENT DOMAIN FOR THE PURPOSE OF CONSTRUCTING ABOVE-GROUND MERCHANT LINES.

HA 3: STATES THAT 50% OF THE MINING ROYALTIES THAT GO TO THE PUBLIC SCHOOLS OF THE COUNTY SHALL BE DIVIDED PROPORTIONALLY BETWEEN THE SCHOOL DISTRICTS THAT LIE OR ARE SITUATED WHOLLY WITHIN FEDERAL LAND BASED ON THE ACRES OF FEDERAL LAND WITHIN EACH DISTRICT'S BOUNDARIES.
