SB 608 - This act creates the Business Premises Safety Act, which provides that a business only has the duty to guard against criminal or harmful acts occurring on the business's premises when the business knows or has reason to know that such acts are being committed or about to be committed by an identifiable person and such acts pose an imminent probability of injury to another identifiable person, and there is sufficient time to prevent such injury. However, a business will not be held liable if the business has implemented reasonable security measures, when the claimant was a trespasser, under the influence of alcohol or a controlled substance, or attempting to or committing a felony. In a civil action for damages against a business for injuries caused by the criminal or harmful acts of a person on the business's property, the claimant must prove by clear and convincing evidence that reasonable security measures would have prevented the criminal or harmful act.
