Current Bill Summary

SB 830 - This act creates the Nuclear Power Plant Security Guard Act.

TRESPASS (Section 578.533) - This act creates the offense of trespass on a nuclear power plant. Such offense is committed if a person knowingly enters or remains unlawfully in a nuclear power plant or within a fenced yard of such plant. Such offense is a Class E felony.

USE OF FORCE BY A SECURITY GUARD (Section 578.534) - This act allows an armed nuclear security guard to use deadly physical force in self-defense, or to prevent an action that would constitute murder, voluntary manslaughter, or assault. This act also allows an armed nuclear security guard to use physical force to prevent an action that would constitute assault, kidnapping, burglary, arson, criminal damage to property, robbery, armed criminal action, or criminal trespass. Further, an armed nuclear security guard is justified in threatening to use force if he or she believes it to be necessary for self-defense. No such guard, employer of a guard, or owner of a nuclear power plant shall be subject to civil liability for conduct permitted under this act.

This act is similar to HB 1797 (2018).
