HCS/HB 1915 - This act modifies provisions relating to merchandising practices.

AMERICAN INDIAN ART (Section 407.315) - This act prohibits merchants from selling articles represented as being made by American Indians unless such article is made by American Indians. Any merchant violating this act may be subject to a $25-$200 fine, 30-90 days in jail, or both.

This provision is substantially similar to HB 1384 (2018) and a provision contained in SS/SCS/HB 1832 (2018).

NO-CALL LIST (Section 407.1107) - Currently, the Attorney General may initiate a proceeding for a violation of the No-Call List, including a civil penalty of $5,000 per violation. This act specifies that the minimum penalty may be $2,500 per violation, and that no person shall have to pay more than $100,000 in penalties for violations that occurred within a 1 month period. Upon a second violation, the penalty shall be $5,000-$10,000, and no person shall have to pay more than $200,000 in penalties for violations that occurred within a 1 month period. Upon a third violation, the penalty shall be $7,500-$15,000. Under this act, it shall be the duty of the Attorney General to distribute such funds, not to exceed $100 per person, to those who reported a violation of the No-Call List.
