HB 1598 - This act provides that the contractual obligations of a provider of funeral services or a seller under a preneed contract shall not cease due to any failure of the provider or seller to renew his or her license, as long as the seller or provider had a valid license at the time the contractual agreement was entered into by the parties.

Currently, a seller of preneed contracts must file an annual financial report with the Board of Embalmers and Funeral Directors or the seller's license shall be suspended until the report is filed and applicable fees are paid. The act states that after filing the report, the license shall be reinstated from the due date. Any contracts entered into while the license was suspended are void and must be rewritten after the license is reinstated or moneys paid by the purchaser shall be refunded.
