SB 97 - This act requires each licensed hospital to adopt, implement, and periodically update evidence-based protocols for the early recognition and treatment of adult and child patients with sepsis, severe sepsis, or septic shock. Sepsis protocols shall be based on generally accepted standards of care as specified in the act, including: (1) screening and early recognition of patients with sepsis, severe sepsis, or septic shock; (2) identification of patients appropriate for treatment, as well as those who should be excluded from the protocols; (3) guidelines for hemodynamic support; (4) guidelines for fluid resuscitation for infants and children; and (5) identification of the infectious source and delivery of antibiotics.

Each hospital shall ensure that all professional staff with direct patient care responsibilities and select professional staff with indirect patient care responsibilities are periodically trained to implement the sepsis protocols. Each hospital shall also be responsible for the collection and use of quality measures related to the recognition and treatment of sepsis, severe sepsis, and septic shock for the purpose of internal quality improvement.

Each hospital shall submit proposed sepsis protocols to the Department of Health and Senior Services within the time frame specified in the act, and shall implement the protocols following approval from the Department. A hospital may revise and update its protocols as necessary and the protocols shall be resubmitted to the Department no more than once every 2 years, unless otherwise directed by the Department.
