HB 380 Modifies provisions relating to traffic violations, municipal judges, and court reporter fees

HCS/HB 380 - This act modifies provisions relating to municipal courts, traffic violations, and court reporter fees.

Traffic Violations (302.335, 304.288, 479.353, 479.354)

This act requires that motorists charged with traffic violations shall receive, within twenty-four hours of the violation, in-person notification from a law enforcement officer employed by the agency issuing the citation. This requirement does not apply to parking tickets, leaving the scene of an accident, incidents requiring further investigation, or any other situation in which in-person notification is not possible.

This provision is identical to provisions in HCS/HB 275 (2017) and SB 315 (2017).

This act prohibits the use of automated traffic enforcement systems to establish evidence a motor vehicle or its operator has committed a traffic-related offense, or to impose or collect any civil or criminal fine, fee, or penalty for such offense.

State agencies and political subdivisions with automated traffic enforcement installation or maintenance contracts existing on the effective date of this act shall complete or terminate the contracts no later than one year after the effective date of this act. This act exempts data and information recorded at weigh stations managed by MODOT or the Missouri State Highway Patrol, but provides that no county, city, town, village, municipality, state agency, or political subdivision shall be exempt from the evidentiary restrictions and contract termination provisions of this act except by express reference to or modification of the relevant section of this act.

These provisions are identical to provisions contained in HCS/HB 275 (2017) and substantially similar to provisions in SB 315 (2017).

When an individual has been held in custody on a notice to show cause warrant for a minor traffic violation, this act allows the court to waive or reduce the original fine or sentence when reasonable.

A defendant must be given the date and time to appear in court at the same time he or she is given a notice to appear in court, citation, or summons for a minor traffic violation, and failure to provide such information shall render the notice to appear void.

These provisions are identical to provisions in HCS/SS/SB 124 (2017), SCS/HCB 1 (2017), and the truly agreed to and finally passed version of SB 128 (2017).

Municipal Judges (479.020)

Under current law, a judge cannot serve as municipal judge in more than five municipalities. This act specifies that a court serving more than one municipality shall be treated as a single municipality for the purposes of this requirement.

This provision is identical to a provision contained in SCS/HCB 1 (2017), the truly agreed to and finally passed version of SB 128 (2017), HCS/SS/SB 124 (2017), and HCS/HB 597 (2017).

Court Reporter Fees (488.2250)

This act repeals provisions of law which specify that court reporters shall receive three dollars and fifty cents a page in proceedings in any circuit court. Also, the act repeals the provision specifying that the court reporter is to be reimbursed three dollars and fifty cents per legal page for the preparation of transcripts.

This provision is identical to SCS/SB 169 (2017), provisions in HCS/HB 597 (2017), provisions in SCS/HCB 1 (2017), and the truly agreed to and finally passed version of SB 128 (2017).
