SB 356 - Current law provides circumstances in which a no-contest clause in an irrevocable trust is not enforceable. This act states that no-contest clauses are also not enforceable against an interested person for filing a claim for relief concerning a breach of trust by a trustee or the removal of a trustee.

This act is identical to provisions in the truly agreed to and finally passed version of SB 128 (2017), SCS/HCB 1 (2017), SCS/HCS/HB 427 (2017), and SCS/SB 171 (2017).
