Current Bill Summary

SB 229 - This act modifies notice requirements for neighborhood organizations seeking to bring nuisance abatement actions in certain cities and counties.

This act repeals a provision of current law, which prohibits neighborhood organizations from bringing nuisance actions if the organization has certain interests in real estate in the city or county in which the nuisance property is located.

This act adds a new definition of "neighborhood organization" for purposes of nuisance abatement actions in Kansas City.

Under current law, nuisances actions are prohibited from being brought against a property owner who is in good faith compliance with an order issued by the Department of Natural Resources, Environmental Protection Agency, or the Attorney General's Office. This act specifies that the prohibition only applies if the court determines the order would prevent municipal enforcement of the code or ordinance.
