SB 553 - Currently, county commissions and county health center boards may make and promulgate ordinances and rules to enhance public health and prevent disease. Under this act, only county commissions shall be able to make and promulgate ordinances and rules with the concurrence of the county health center boards. Such ordinances shall not conflict with any regulations authorized by the Department of Health and Senior Services or certain regulations promulgated by Department of Natural Resources. Under this act, no structure used for agricultural purposes or agricultural activity shall be subject to any public health or disease prevention ordinances or rules adopted by a county commission.

Currently, the Department of Natural Resources provisions of law relating to concentrated animal feeding operations shall not be construed as restricting local controls. Under this act, this provision is repealed.

This act is identical to HB 999 (2015), and is similar to a provision contained in HCS/SB 506 (2014), HCS/HB 1728 (2014), HCS/HB 880 (2013), and HCS/SB 342 (2013).
