House Amendment

HCS/SCS/SB 473 - This act modifies provisions relating to school directors for urban school districts.

SECTION 160.671 - This act creates a procedure for recalling school board members in the St. Joseph School District. A recall election shall be held upon the submission of a petition signed by at least three hundred registered voters of the district.

If a majority of voters vote to retain the school board member at issue, the member shall remain in office and cannot be subject to another recall election during his or her term. If a majority of voters vote to remove the member, the successor member will be chosen by the Buchanan County Commission and will serve until the next school board election.

This section expires on December 31, 2021.

SECTION 162.471 - This act requires that any vacancies on the St. Joseph School District's school board be filled by the Buchanan County Commission. A member who fills a vacancy will be appointed to serve until the next school board election.

SECTION 162.481 - Currently, the Springfield School District is an urban school district that was previously exempted from school board member terms of six years in length. This act updates the description of the city of Springfield and provides that the exemption from the six-year school board member term only applies to urban school districts located in the City of Springfield.

This act repeals obsolete language relating to the election of school board members in the Springfield School District from the 1960 decennial census.

Currently, the St. Joseph School District school board members serve a term of six years. This act changes the term of office from six years to three years beginning at the municipal election in 2016.

This section is similar to SCS/SB 315 (2015) and a section contained in SS/SCS/HCS#2/HB 63 (2015).

SECTION 162.491 - This act provides that a candidate for school board in the St. Joseph School District file a declaration of candidacy with the board secretary and is not required to submit a petition.

This act contains an emergency clause.

HA 1 - THIS HOUSE AMENDMENT INCREASES THE NUMBER OF SIGNATURES REQUIRED FOR THE RECALL PROCEDURES FROM 300 TO 750.

HA 2 - THIS HOUSE AMENDMENT PROVIDES THAT IN ANY SCHOOL YEAR WHEN A DISTRICT'S AVERAGE DAILY ATTENDANCE INCREASES FROM 350 OR LESS TO MORE THAN 350, OR DECREASES FROM MORE THAN 350 TO 350 OR LESS, THE DISTRICT WILL RECEIVE STATE AID BASED ON THE DISTRICT'S AVERAGE DAILY ATTENDANCE IN THE SCHOOL YEAR IMMEDIATELY PRECEDING THE INCREASE OR DECREASE. THE DISTRICT WILL CONTINUE TO RECEIVE STATE AID BASED ON THE DISTRICT'S IMMEDIATELY PRECEDING ADA IN THE PREVIOUS SCHOOL YEAR UNTIL THE INCREASE OR DECREASE IN ADA IS MAINTAINED FOR TWO CONSECUTIVE SCHOOL YEARS. WHEN THE ADA IS MAINTAINED FOR TWO CONSECUTIVE SCHOOL YEARS, THE DISTRICT WILL RECEIVE STATE AID BASED ON THE ADA MAINTAINED FOR THE TWO SCHOOL YEARS.
