SB 99 - Under this act, any person involved in the production, sale, distribution, or administration of prescription medications who has reason to suspect that counterfeit, fake, diluted, or black market drugs are being distributed must report, or cause a report to be made, within 7 business days to the Food and Drug Administration, the State Board of Pharmacy, or a law enforcement agency. Failure to make such a report is a class A misdemeanor.

Any employee of a drug or pharmaceutical company that attempts to conceal information about suspected counterfeit, fake, diluted, or black market drugs, or any other drug being distributed that could result in death or serious physical injury is guilty of a Class D felony for an offense committed on or before December 31, 2016, and a Class E felony for an offense committed after December 31, 2016.

This act is substantially similar to SB 665 (2014) and SB 369 (2013) and is similar to HB 592 (2013) and HB 1699 (2012).
