HB 33 Modifies provisions relating to persons eligible to receive survivor's benefits

SCS/HCS/HB 33 - This act modifies the definition of public safety officer as it relates to the Public Service Officer's or Employee's Child Survivor Grant Program to include any uniformed employee of the Office of the State Fire Marshal and certain emergency medical technicians.

The act also modifies the definition of firefighter to include uniformed employees of the office of the State Fire Marshall and certain emergency medical technicians for purposes of certain workers' compensation provisions.

Provisions relating to claims for compensation under the Line of Duty Compensation Act are modified by this act. Any claim for compensation may be made by the spouse, child or personal representative of the estate of the deceased with the Division of Workers' Compensation within a specified time period.

If a claim is made within the proper time frame, compensation shall be paid in the following manner:

• If there is a surviving spouse but no surviving children then to the surviving spouse;

• If there is a surviving spouse and at least one surviving child, then 50% to the surviving spouse and 50% in equal shares to each surviving child;

• If there is no surviving spouse and at least one surviving child, then to the surviving children in equal shares; and

• If there is no surviving spouse or surviving children then to the decedent's estate.
