Current Bill Summary

SB 863 - This act provides that no civil action shall be brought against a sheriff, deputy sheriff, or a sheriff's administrative employee for actions performed in compliance with a court order. If an action is filed and the sheriff, deputy sheriff, or administrative employee is the prevailing party, then the plaintiff shall be pay the defendant's court costs and reasonable attorneys fees.

This act does not limit the liability of sheriffs, deputy sheriffs, or their administrative employees for neglecting or refusing to execute a court order. Nor does it limit the liability of persons who request a court order using fraud or dishonest statements.

This act is similar to HB 1816 (2014).
