House Amendment

SB 796 - Current law requires the parties to the marriage to present an application to the recorder of deeds in person. This act establishes a procedure for a recorder of deeds to issue a marriage license if one of the applicants is incarcerated and is unable to appear in the presence of the recorder.

This act is identical to SS/SCS/HB 1514 (2014).

HA 1- ADDS A MILITARY PERSON WHO IS UNABLE TO PERSONALLY APPEAR BECAUSE OUT OF STATE OR COUNTRY; REMOVES REQUIREMENT FOR PROOF OF A SOCIAL SECURITY NUMBER AND THAT NOTARIZED APPLICATIONS ARE ACCEPTABLE IF AN INCARCERATED PERSON DOES NOT HAVE IDENTIFICATION; ADDS AN EMERGENCY CLAUSE
