SB 649 - This act modifies provisions relating to right-of-way of political subdivisions. This act technically corrects a paragraph cross-reference and technically corrects "permit" to "permits". Currently, a public utility right-of-way user that has been denied a permit may bring an action for review in any court of competent jurisdiction. This act specifies that the court must be in this state. Currently, no political subdivision shall require any public utility granted right-of-way access prior to August 28, 2001, to enter into an agreement or obtain a permit for general access to remain in the right of way. This act removes this date and allows any public utility that has been granted right-of-way access to remain in the right-of-way without entering into an agreement or obtaining a permit for general access.
