SS/SB 498 - This act creates a private cause of action against navigators for individuals whose private identifying information has been released to anyone other than necessary state agencies, federal agencies, insurance companies, or other entities with lawful access to the information for the purpose of obtaining health insurance. The private cause of action does not require intent to release the personal information or proof of injury and proscribes damages at $50,000 and requires health benefit exchange navigators to be covered by a bond to pay any judgments awarded under the terms of this act.
