SB 652 - This act specifies that a railroad or railroad corporation shall only reject a proposed crossing if special circumstances exist. Currently, if the parties cannot agree that special circumstances exist, the dispute is submitted to binding arbitration in accordance with the commercial rules of arbitration. This act specifies that the rules of arbitration may be in accordance with the commercial rules of arbitration or as agreed to by the parties. The provisions of this act shall not override or nullify the condemnation laws of this state or confer the power of eminent domain on any entity not granted such power prior to August 28, 2014. Further, the provisions of this act shall apply to a crossing commenced after August 28, 2014, unless the existing agreement has terminated or expired for such crossing.
