HB 1454 - Currently, authorities are required to respond to an application for substantial modification of a wireless support structure within 90 days. Further, if an application is deficient, the applicant may cure the deficiencies at which point the authority has 90 days to review and process the application. Currently, if the authority fails to act on an application within 90 days, the application is approved. This act modifies these application timelines from 90 to 120 days. Currently, any party aggrieved by a final action of an authority may bring an action in any court of competent jurisdiction. This act specifies that the court shall be within this state.
This act is substantially similar to a provision contained in SS/SCS/SB 650 (2014).
