Current Bill Summary

SB 641 - Under current law, the definition of ultimate user includes a person who lawfully possesses a controlled substance for his or her own use or the use of a household member.

This act expands the definition to include a person who lawfully possesses a controlled substance for the use of a member of the person's immediate family regardless of whether the family member resides in the household. "Immediate family" is defined as including a husband, wife, parent, child, sibling, stepparent, stepchild, stepbrother, stepsister, grandparent, or grandchild.

This provision is contained in the truly agreed to and finally passed HCS/SS/SCS/SB 491 (2014).
