SB 186 - The act provides that an entity in possession of cremated remains shall release the required information to the Department of Veterans Affairs or veterans service organization to obtain verification for eligibility of burial at a state or national veterans' cemetery. The act specifies what information is required and defines veterans service organization for the purposes of the act.

Before transporting the cremated remains to a veterans' cemetery, the entity in possession of the cremated remains must meet the following criteria: 1) make reasonable efforts to locate the agent who has the right to control the cremated remains, 2) there must have been no attempt by an agent or family member to claim the cremated remains, and 3) the entity must possess the cremated remains for at least one year.

The act also states that an entity which releases information required for verification on the cremated remains is not subject to civil liability, and a veterans' service organization receiving the cremated remains under this act shall not be liable for negligence.
