HCS/HB 285 - This act creates the Class A felony of distribution of a controlled substance near a child care facility.

A person commits the offense by distributing or delivering any controlled substance to a person in, on, or within 200 feet of a child care facility, a child placing agency, or a residential care facility.

If the offender is found to be a persistent drug offender, he or she shall serve any sentence imposed for the offense without probation or parole.
