Current Bill Summary

SB 424 - This act requires an employee of a county or city jail who has reasonable cause to believe an offender in the jail has been abused to immediately report it in writing to the sheriff.

Any employee who fails to report within a reasonable time is guilty of a Class A misdemeanor.

Upon receiving the report, the sheriff must initiate an investigation within 24 hours. If the investigation indicates possible abuse, the investigator must refer the complaint and report to the sheriff for appropriate action.

This act provides that reports of abuse are confidential, not a public record for purposes of the open records law, and not subject to public inspection.
