SS/SCS/SB 806 – This act modifies provisions relating to the employment of school personnel.

TENURE SYSTEMS: This act ends the teacher tenure systems. Currently, two teacher tenure systems exist in the state, one for the St. Louis City School District and one for all other districts. These two systems will expire beginning on July 1, 2013. (Repeal of Sections 168.101 to 168.130, 168.201, 168.211, 168.221)

REDUCTION IN FORCE: A school board may place teachers on leave of absence because of a decrease in student enrollment, district reorganization, or financial condition. Seniority or years of service cannot be used as criteria for reduction in force; effective teacher performance will be the deciding criterion. Additional procedures are described when financial condition is the reason for a reduction in force. (Section 168.1022)

This act has a delayed effective date of July 1, 2013. (Section B)

SA 1: THIS SENATE AMENDMENT REPEALS SECTION 168.291, WHICH GOVERNS A REDUCTION IN FORCE FOR NON-CERTIFIED EMPLOYEES IN THE ST. LOUIS CITY SCHOOL DISTRICT.

SA 2: THIS SENATE AMENDMENT REPEALS SECTION 168.124, WHICH GOVERNS HOW A SCHOOL BOARD PLACES TEACHERS ON LEAVE OF ABSENCE (REDUCTION IN FORCE).

SA 3: THIS SENATE AMENDMENT DEFINES "ADVERSE FINANCIAL CONDITIONS" AS A FIVE PERCENT DECREASE IN A SCHOOL DISTRICT'S FUND BALANCE FROM THE PREVIOUS SCHOOL YEAR FOR PURPOSES OF SECTION 168.1022, WHICH ALLOWS A SCHOOL DISTRICT TO UNDERGO A REDUCTION IN FORCE IN AN ATTEMPT TO MANAGE ADVERSE FINANCIAL CONDITIONS.

SA 4: THIS SENATE AMENDMENT REQUIRES THE JOINT COMMITTEE ON EDUCATION TO OVERSEE A TASK FORCE ON TEACHER COMPENSATION AND EFFECTIVENESS AND MAKE RECOMMENDATIONS TO THE GENERAL ASSEMBLY.

THIS AMENDMENT ALSO ELIMINATES THE REPEAL OF THE FOLLOWING SECTIONS: 168.101, 168.102, 168.104, 168.106, 168.108, 168.110, 168.112, 168.114, 168.116, 168.118, 168.120, 168.122, 168.126, 168.128, 168.130, 168.201, 168.211, 168.211.
