HB 103 - Public safety agencies are allowed to enter into mutual-aid agreements with other public and private agencies for reciprocal emergency aid.

The mutual-aid system shall be administered by the department of public safety.

Activities performed under mutual-aid agreements during an emergency that is not declared by the governor as such are deemed to be governmental functions. Responders are subject to the liability and workers' compensation provisions provided to them as employees of their respective political subdivision or public safety agency.

During emergencies declared by the governor, responders shall not be liable for civil damages or administrative sanctions for failing to exercise the ordinary skills and learning of such a professional in such circumstances. Responders shall remain liable for damages due to willful and wanton acts or omissions.
