SCS/SB 1094 - This act provides that a pharmacy, when filling a prescription that has been prescribed for the treatment of epilepsy that denotes that the drug is from a specific manufacturer, be it generic or name brand, shall not interchange the drug for any other from another manufacturer other than the one specified in the prescription, unless the patient is notified of the interchange upon the delivery of the prescription. If such drug is interchanged, the pharmacy that fills such prescription shall notify the prescribing physician within forty-eight hours of the delivery of the prescription. The requirement under this act shall not apply to prescriptions dispensed for inpatients of a hospital, nursing home, assisted living facility, or inpatients of a mental health or residential facility.

This act is identical to SB 634 (2007).
