HB 851 Provides for state enforcement of federal immigration laws

SCS/HCS/HB 851 - Law enforcement officers must inquire into the immigration status of any individual arrested for a violation of any state law or municipal ordinance. If the individual is found to be illegal, the officer shall cooperate with any request from federal authorities regarding detention and custody transfer.

The superintendent of the Highway Patrol shall negotiate cooperative agreements with the federal government to designate state law enforcement officers to help enforce federal immigration law.

The act exempts persons who were serving as reserve officers on August 27, 2001, from basic training requirements established by the POST Commission for licensure as a reserve peace officer in the county where they served.

This act is similar to SB 348 (2007), and SB 461 (2007).
