AN ACT

To repeal section 570.033, RSMo, and to enact in lieu thereof one new section relating to selling animals for research purposes, with penalty provisions.


 

Be it enacted by the General Assembly of the State of Missouri, as follows:

            Section A. Section 570.033, RSMo, is repealed and one new section enacted in lieu thereof, to be known as section 570.033, to read as follows:

            570.033. 1. Any person who, without lawful authority, willfully takes another's animal with the intent to deprive him of his property is guilty of a class D felony.

            2. Any person who brokers or sells animals for research purposes shall be required to hold such animals in his or her custody for thirty days, with adequate care, food, shelter, and provide basic medical attention before selling the animals for research purposes. During that time, the person shall post a picture of each animal held in his or her custody on an Internet website easily accessible to the public. If an individual views his or her animal on an Internet website of this nature, he or she shall contact the person holding the animal and such person shall, upon providing adequate proof that the animal belongs to him or her, have the animal returned to his or her custody within five days.

            3. Failing to meet the requirements of subsection 2 of this section shall be prima facie evidence that the animal is stolen property under the provisions of subsection 1 of this section.
