AN ACT

To authorize the conveyance of property owned by the state in Nodaway County to the Delta Nu Teke Association.


 

Be it enacted by the General Assembly of the State of Missouri, as follows:

            Section 1. 1. The governor is hereby authorized and empowered to sell, transfer, grant, and convey all interest in fee simple absolute in property owned by the state in Nodaway County to the Delta Nu Teke Association, a not-for-profit corporation in exchange for a similar parcel of land described in subsection 2 of this section. The property to be conveyed is more particularly described as follows:

A tract of land located in the County of Nodaway, State of Missouri described as follows:

Commencing at the Southeast Corner of Lot One (1), Block Twenty-two (22) of Saunders Addition to the City of Maryville, Nodaway County, Missouri; thence along the East line of said block, North 01 degrees 41 minutes 46 seconds East 305.70 feet to the centerline of the former Norfolk and Southern Railroad; thence along said centerline, North 81 degrees 35 minutes 15 seconds West 453.00 feet; thence departing from said centerline, South 08 degrees 24 minutes 45 seconds West 35.92 feet to the Northeast Corner of a tract of land defined by Deed Book 452, Page 127, Nodaway County Recorder's Office, thence along the East Line of said tract, South 26 degrees 31 minutes 54 seconds East 130.00 feet to the Point of Beginning, said point being the Southeast Corner of said tract conveyed by Deed Book 452, Page 127, Nodaway County Recorder's Office; thence South 63 degrees 28 minutes 08 seconds West 145.00 feet to the Southwest Corner of said tract; thence North 26 degrees 31 minutes 54 seconds West 30.00 feet; thence North 63 degrees 28 minutes 08 seconds East 145.00 feet; thence South 26 degrees 31 minutes 54 seconds East 30.00 feet; to the point of beginning.

            2. In exchange for the tract of land conveyed in subsection 1 of this section, the state shall receive property described as follows:

A tract of land located in the County of Nodaway, State of Missouri described as follows:

Commencing at the Southeast Corner of Lot One (1), Block Twenty-two (22) of Saunders Addition to the City of Maryville, Nodaway County, Missouri; thence along the East line of said block, North 01 degrees 41 minutes 46 seconds East 305.70 feet to the centerline of the former Norfolk and Southern Railroad; thence along said centerline, North 81 degrees 35 minutes 15 seconds West 453.00 feet; thence departing from said centerline, South 08 degrees 24 minutes 45 seconds West 35.92 feet to the Northeast Corner of a tract of land defined by Deed Book 452, Page 127, Nodaway County Recorder's Office, thence along the East Line of said tract, South 26 degrees 31 minutes 54 seconds East 47.68 feet; thence North 81 degrees 35 minutes 15 seconds West 176.89 feet to the Point of Beginning; thence South 26 degrees 31 minutes 54 seconds East 153.63 feet thence South 34 degrees 46 minutes 48 seconds West 100.40 feet; thence North 27 degrees 06 minutes 32 seconds West 82.93; thence North 32 degrees 07 minutes 42 seconds West 113.67 feet; thence North 30 degrees 09 minutes 32 seconds West 79.30 feet; thence South 81 degrees 35 minutes 15 Seconds East 128.10 feet to the point of beginning.

            3. The commissioner of administration shall set the terms and conditions for the sale as the commissioner deems reasonable. Such terms and conditions may include, but are not limited to, the number of appraisals required, the time, place, and terms of the sale.

            4. The attorney general shall approve the form of the instrument of conveyance.
