AN ACT
To amend chapter 64, RSMo, by adding thereto one new section relating to flood plains.
Be it enacted by the General Assembly of the State of Missouri, as follows:
Section A. Chapter 64, RSMo, is amended by adding thereto one new section, to be known as section 64.003, to read as follows:
64.003. No more than fifty percent of any flood plain in any county shall be used for residential, industrial, or commercial use. For the purpose of this section, "flood plain" shall be defined as in section 135.478, RSMo. Property shall be deemed for residential use if it would qualify as "residential property" as defined in section 137.016, RSMo, and shall be deemed for industrial or commercial use if it would qualify as "utility, industrial, commercial, railroad and other real property" as defined by section 137.016, RSMo. Upon the effective date of this section, if a flood plain has more than fifty percent of its area used for residential, industrial, or commercial purposes, such percentage may be maintained, but shall not increase.
