SB 1360 - This act extends the statute of limitations on civil claims for damages caused by sexual abuse suffered as a child. Under current law, a claim must be brought within three years from the date the victim should have discovered the injury or illness or within five years of the victim's eighteenth birthday, whichever occurs later.
The act extends the statute of limitations to allow an action to be brought within ten years of the victim turning 21 years old or within three years of the date of discovering that the injury or illness was caused by childhood sexual abuse, whichever occurs later.
The act is identical to HB 1436 (2004).
