AN ACT

To amend chapter 640, RSMo, by adding thereto two new sections relating to the calculation of Hancock refunds.


Be it enacted by the General Assembly of the State of Missouri, as follows:

Section A. Chapter 640, RSMo, is amended by adding thereto two new sections, to be known as sections 640.080 and 640.081, to read as follows:

640.080. 1. The state shall not utilize moneys in the water and wastewater loan fund established pursuant to section 644.122, RSMo, the water pollution permit fee subaccount of the natural resources protection fund established in section 640.220, or the water and wastewater loan revolving fund, or any fund established by the office of administration for the sole purpose of receiving and distributing state match bond proceeds, for the purpose of paying any portion of a future refund mandated under article X, section 18, of the Missouri Constitution if the United States Environmental Protection Agency determines that the use of any such moneys for paying such a refund would violate the federal Clean Water Act, the federal Safe Drinking Water Act, or any related federal regulation.

2. The department of natural resources shall, subject to appropriation, reimburse the state general revenue fund from funds that are appropriated to the department for any disproportionate impact on the state's general revenue fund that occurs as a result of subsection 1 of this section for any such refund that occurs after August 28, 2004.

640.081. The state shall not utilize for the purpose of paying any portion of a future refund mandated under article X, section 18, of the Missouri Constitution moneys deposited in the state parks earnings fund established pursuant to section 253.090, RSMo, the Arrow Rock state historic site endowment fund established pursuant to section 253.092, RSMo, the confederate memorial park fund referenced pursuant to section 253.120, RSMo, the Doctor Edmund A. Babler memorial state park fund established pursuant to section 253.360, RSMo, the Pansy Johnson-Travis memorial state gardens trust fund established pursuant to section 253.380, RSMo, the Meramec-Onondaga state parks fund established pursuant to section 253.520, RSMo, where such deposited monies were gifts made for the benefit of the state park system or the interest derived from such gifts.
