AN ACT

To amend chapter 192, RSMo, by adding thereto one new section relating to the office of pharmaceutical reporting.


Be it enacted by the General Assembly of the State of Missouri, as follows:

Section A. Chapter 192, RSMo, is amended by adding thereto one new section, to be known as section 192.1010, to read as follows:

192.1010. 1. There is hereby created within the department of health and senior services the "Missouri Office of Pharmaceutical Reporting". The office of pharmaceutical reporting shall monitor the data transmitted from licensed pharmacies for any unusual or increased prescription rates; any unusual types of prescriptions; or any unusual trends in pharmacy visits occurring within forty-eight hours that may be potential causes of a public health emergency.

2. As used in this section, "public health emergency" shall mean an occurrence or imminent threat of an illness or health condition that is believed to be caused by any of the following:

(1) Bioterrorism, as defined in section 44.010, RSMo;

(2) The appearance of a novel or previously controlled or eradicated infectious agent or biological toxin; or

(3) A chemical attack or accidental release;

which would result in a large number of deaths in the affected population; a large number of serious or long-term disabilities in the affected population; or widespread exposure to an infectious or toxic agent that poses a significant risk of substantial future harm to a large number of people in the affected population.

3. In addition to the requirements of section 338.100, RSMo, the electronic data processing system used by licensed pharmacies for record keeping shall transmit to the office of pharmaceutical reporting, the form and content of which shall be determined by the department in consultation with the office of pharmaceutical reporting:

(1) Any unusual increase in the number of prescriptions or over-the-counter pharmaceuticals to treat conditions that the department shall specify through regulations;

(2) Any unusual increase in the number of prescriptions for antibiotics; and

(3) Any prescription that treats a disease that is relatively uncommon or may be associated with bioterrorism.

As used in this subsection, "unusual increase" shall mean any increase that would alter or alarm a licensed pharmacist of a potential public health emergency.

4. The office of pharmaceutical reporting shall be responsible for the inspection and investigation of any reported abnormalities. The office of pharmaceutical reporting shall notify the local public health agency and the department of homeland security in a timely manner of any potential public health emergency.
