AN ACT

To amend chapter 577, RSMo, by adding thereto one new section relating to restitution for emergency response costs.


Be it enacted by the General Assembly of the State of Missouri, as follows:

Section A. Chapter 577, RSMo, is amended by adding thereto one new section, to be known as section 577.063, to read as follows:

577.063. 1. For the purposes of this section, the term "emergency response" shall mean any incident requiring a response by a peace officer, firefighter included on the payroll of a regularly constituted fire department or fire protection district, or an ambulance.

2. In addition to any other fine or penalty required by law, an individual who is convicted, found guilty of, or pleads guilty to a violation of state law or a local ordinance because of his or her operation of a motor vehicle that proximately caused an incident resulting in an appropriate emergency response, shall be required to make restitution to the public agency for the costs of such an emergency response. Neither a fine nor restitution ordered pursuant to this section shall be the sole disposition for a felony and either or both may be imposed only in conjunction with another disposition.
