AN ACT

To amend chapter 115, RSMo, by adding thereto one new section relating to convicted criminals seeking or holding public office.


Be it enacted by the General Assembly of the State of Missouri, as follows:

Section A. Chapter 115, RSMo, is amended by adding thereto one new section, to be known as section 115.348, to read as follows:

115.348. 1. No person shall either qualify as a candidate for elective public office, or take or hold public elective office in the state of Missouri who has been convicted of or pled guilty to a felony or misdemeanor under the federal laws of the United States of America.

2. The conviction of or plea of guilty to either a felony or misdemeanor designated in subsection 1 of this section shall result in the automatic suspension of an individual currently holding office from their public office. The suspension shall continue until all appellate review of the original trial court proceedings are exhausted. During the period of suspension, the public official shall not perform any official act, duty, obligation, or function nor shall such official receive any compensation, pay, entitlement allowance, emolument, or privilege of the office.
