AN ACT
To amend chapter 488, RSMo, by adding thereto one new section relating to court costs in the twenty-third judicial circuit.
Section A. Chapter 488, RSMo, is amended by adding thereto one new section, to be known as section 488.2207, to read as follows:
488.2207. 1. In addition to all court fees and costs prescribed by law, a surcharge of up to ten dollars shall be assessed as costs in each court proceeding filed in the twenty-third judicial circuit in all civil and criminal cases, including violations of any county or municipal ordinances and any violations of criminal or traffic laws of the state, including an infraction, except that no such surcharge shall be collected in any criminal or traffic proceeding when the proceeding or defendant has been dismissed by the court or when costs are to be paid by the state, county, or municipality. For civil cases and violations of the general criminal laws of the state or county ordinances, no such surcharge shall be collected unless it is authorized by order, ordinance, or resolution of the governing body of the county. For violations of municipal ordinances, no such surcharge shall be collected unless it is authorized by the municipal government where the violation occurred. Such surcharges shall be collected and disbursed by the clerk of the court in the manner provided by sections 488.010 to 488.020, and shall be payable to the treasurer of the county.
2. The county shall use all funds received pursuant to this section only to pay for costs associated with the operation of judicial facilities of the twenty-third judicial circuit, including but not limited to construction, improvement, maintenance, and operations. The county shall maintain records identifying such costs, and any moneys not used for such costs of such facilities of the circuit shall be transmitted annually to a special revenue fund of the county, to be accumulated and invested, and used solely for the payment of costs associated with the operation of judicial facilities of the twenty-third judicial circuit.
