AN ACT

To amend chapter 488, RSMo, by adding thereto one new section relating to court filing fees.


Be it enacted by the General Assembly of the State of Missouri, as follows:

Section A. Chapter 488, RSMo, is amended by adding thereto one new section, to be known as section 488.434, to read as follows:

488.434. 1. Prior to adjustment by the supreme court, in addition to any other fees authorized by statute, the clerk of each court of this state shall collect the following fees, costs, and charges:

(1) Eighty dollars for each intervenor in a circuit division civil case and thirty dollars for each intervenor in an associate circuit division civil case;

(2) Ten dollars for each third-party plaintiff filing a cross-claim or counterclaim in a circuit division civil case and ten dollars for each third-party plaintiff filing a cross-claim or counterclaim in an associate circuit division civil case;

(3) Fifty dollars for a jury fee to be paid at the time the jury is demanded by any party demanding a jury. The jury fee shall be taxed in favor of the party paying the jury fee in the bill of costs in the action, if final judgment thereon is rendered in his favor;

(4) Eighty dollars for the filing of a foreign judgment;

(5) Thirty dollars for the transcribing of a judgment issued pursuant to chapter 517, RSMo, to the circuit division;

(6) Twenty-five dollars for a motion of change of venue to be paid by the party filing the motion. The fee shall be paid to the clerk of the court to which the venue is changed;

(7) Fifteen dollars for the issuance of writs of attachment, execution, or garnishment;

(8) Five dollars for a records search fee conducted if requested by a person who is not a party named in the action for which the search is being requested.

2. Notwithstanding any other provision of law, the moneys collected by clerks of the courts pursuant to the provisions of subsection 1 of this section shall be collected and disbursed in accordance with sections 488.010 to 488.020, and shall be payable to the state treasurer.

3. The state treasurer shall deposit such funds into the state school moneys fund. Such moneys shall be deposited on a monthly basis and shall be distributed in the manner provided in section 163.031, RSMo.
