AN ACT

To amend chapter 389, RSMo, by adding thereto one new section relating to railroad company employees, with penalty provisions.


Be it enacted by the General Assembly of the State of Missouri, as follows:

Section A. Chapter 389, RSMo, is amended by adding thereto one new section, to be known as section 389.798, to read as follows:

389.798. 1. It shall be unlawful for a railroad company or person employed by a railroad company to:

(1) Deny, delay, or interfere with medical treatment to an employee of a railroad company who has been injured during employment; or

(2) Discipline or threaten discipline to an employee of a railroad company who has been injured during employment for requesting medical treatment or first aid treatment for such injury.

2. A railroad company or any person who violates the provisions of this section shall be guilty of a class D felony and may be fined not more than ten thousand dollars for each violation.
