AN ACT
To amend chapter 15, RSMo, by adding thereto one new section relating to state contracts.
Section A. Chapter 15, RSMo, is amended by adding thereto one new section, to be known as section 15.006, to read as follows:
15.006. The following provisions shall apply to all state contracts:
(1) The state shall not award a contract to a contractor or subcontractor who performs the contracted work at a site outside the United States;
(2) Each vendor submitting a bid or contract to provide services for the state shall certify that the services covered by the bid or contract will be performed in the United States;
(3) If, during the term of the contract, the contractor or subcontractor transfers the contracted work to a location outside the United States, the state shall require the contractor or subcontractor to pay damages in an amount equal to the amount paid by the state for the percentage of outsourced work. The state shall also terminate the contract for noncompliance;
(4) The state shall be entitled to bring a civil action in state or federal court to compel enforcement of this law. The court shall award reasonable attorneys' fees and costs to the state.
