AN ACT

To amend chapter 67, RSMo, by adding thereto one new section relating to mechanical codes.


Be it enacted by the General Assembly of the State of Missouri, as follows:

Section A. Chapter 67, RSMo, is amended by adding thereto one new section, to be known as section 67.2045, to read as follows:

67.2045. 1. Any county of the first classification with more than one hundred ninety-eight thousand but less than one hundred ninety-nine thousand two hundred inhabitants may enact an ordinance creating a mechanical code in order to ensure the proper licensing of mechanical contractors and workers.

2. The provisions of a mechanical code must provide for, but are not limited to, the following:

(1) The creation and compensation of a "Committee of Mechanical Code Review" for the purposes of considering proposed changes to the mechanical code;

(2) The licensing of contractors and workers engaged in or performing HVAC servicer-installer work, process piping system work, HVAC duct system work, or fire suppression system work; and

(3) The registration of proof of financial responsibility prior to licensing by any company, corporation, partnership, joint venture, individual, or other business entity that performs work that requires a permit under the mechanical code.

3. An ordinance enacted pursuant to this section may create a board of examiners for mechanical licensing to oversee the licensing of mechanical contractors and workers and the enforcement of the provisions of this code.
