AN ACT

To amend chapter 565, RSMo, by adding thereto one new section relating to human cloning, with penalty provisions.


Be it enacted by the General Assembly of the State of Missouri, as follows:

Section A.Chapter 565, RSMo, is amended by adding thereto one new section, to be known as section 565.305, to read as follows:

565.305.1.As used in this section, the following words and phrases shall mean:

(1)"Cloning", the production of a precise genetic copy of a molecule, including deoxyribonucleic acid (DNA), or of chromosomes;

(2)"Human cloning", the creation of or attempt to create a human being by transferring the nucleus from a human cell from whatever source into an oocyte from which the nucleus has been removed;

(3)"Nucleus", the cell structure that houses the chromosomes, and, thus, the genes;

(4)"Oocyte", the ovum or egg;

(5)"Public employee", any person employed by the state of Missouri or any agency or political subdivision thereof;

(6)"Public facilities", any public institution, public facility, public equipment, or any physical asset owned, leased, or controlled by the state of Missouri or any agency or political subdivision thereof;

(7)"Public funds", any funds received or controlled by the state of Missouri or any agency or political subdivision thereof, including, but not limited to, funds derived from federal, state or local taxes, gifts or grants from any source, public or private, federal grants or payments, or intergovernmental transfers.

2.In addition to the provisions of section 1.217, RSMo:

(1)No person shall knowingly engage in human cloning, or participate in human cloning;

(2)No person shall knowingly use public funds to engage in human cloning or attempting to engage in human cloning;

(3)No person shall knowingly use public facilities for the purpose of engaging in human cloning or attempting to engage in human cloning; or

(4)No public employee shall knowingly allow any person to engage in human cloning or attempt to engage in human cloning while making use of public funds or public facilities.

3.Violation of the provisions of subdivisions (1) to (4) of subsection 2 of this section shall be a class B felony.
