AN ACT

To amend chapter 210, RSMo, by adding thereto one new section relating to missing persons.


Be it enacted by the General Assembly of the State of Missouri, as follows:

Section A.Chapter 210, RSMo, is amended by adding thereto one new section, to be known as section 210.1012, to read as follows:

210.1012.1.There is hereby created a statewide program called the "Amber Alert Program" referred to in this section as the "program", to aid in the identification and location of abducted persons.

2.For the purposes of this section, "abducted person" means a person whose whereabouts are unknown and whose disappearance poses a credible threat of immediate danger of serious bodily harm or death to a person as determined by local law enforcement.

3.There is hereby created a statewide "Amber Alert Advisory Board".The state Amber alert coordinator shall be the presiding officer of the board, to serve without compensation.The board shall consist of the attorney general, or a representative appointed by the attorney general, and one representative of law enforcement, one representative of the media, and one citizen representative from each Amber alert region, to serve without compensation.The purpose of the board is to aid in the implementation and operation of the Amber alert program.

4.The department of public safety shall establish a statewide Amber alert system and shall coordinate federal, state and local resources and the media to disseminate information about an abducted person.

5.The department of public safety shall develop regions to provide the program.The department of public safety shall coordinate local law enforcement agencies and public commercial television and radio broadcasters to provide an effective program.

6.The department of public safety shall have the authority to notify other regions when there is credible evidence that an abduction suspect is moving across regions.

7.Currently existing alert programs operating as of August 28, 2003, shall become compliant with the department of public safety system by January 1, 2004.

8.There shall be appointed a state Amber alert coordinator within the department of public safety to coordinate efforts between federal, state and local entities.

9.The director of the department of public safety shall promulgate rules for the implementation of a statewide program, including notification and verification procedures.Any rule or portion of a rule, as that term is defined in section 536.010, RSMo, that is created under the authority delegated in this section shall become effective only if it complies with and is subject to all of the provisions of chapter 536, RSMo, and, if applicable, section 536.028, RSMo.This section and chapter 536, RSMo, are nonseverable and if any of the powers vested with the general assembly pursuant to chapter 536, RSMo, to review, to delay the effective date or to disapprove and annul a rule are subsequently held unconstitutional, then the grant of rulemaking authority and any rule proposed or adopted after August 28, 2003, shall be invalid and void.
