AN ACT

To amend chapter 407, RSMo, by adding thereto one new section relating to the use of social security numbers, with an effective date and penalty provisions.


Be it enacted by the General Assembly of the State of Missouri, as follows:

Section A.Chapter 407, RSMo, is amended by adding thereto one new section, to be known as section 407.1355, to read as follows:

407.1355.1.A person or entity, not including a state or local agency, shall be prohibited from the following:

(1)Intentionally communicating or otherwise making available to the general public in any manner an individual's social security number;

(2)Printing an individual's social security number on any card required for the individual to access products or services provided by the person or entity;

(3)Requiring an individual to disclose his or her social security number to enter into a commercial transaction;

(4)Requiring an individual to transmit his or her social security number over the Internet unless the connection is secure or the social security number is encrypted;

(5)Requiring an individual to use his or her social security number to access an Internet web site;

(6)Printing an individual's social security number on any materials that are mailed to the individual.

2.This section does not prevent the collection, use or release of a social security number as required by state or federal law.

3.Any person or entity who violates any provision of this section shall be subject to all penalties, remedies and procedures provided in sections 407.010 to 407.130.

Section B.The enactment of section 407.1355 of this act shall become effective on January 1, 2005.
